Story:
 
She put a offer for her buyer client was accepted by seller with Mortgage condition, but unfortunately her buyer can not get mortgage [The price is out of buyer down payment] range  approve by end of the 5 days for this condition, and no waiver send instead was a mutual release. But seller refused to sign mutual release, as the buyer consult from legal option said should go to small claim court to claim back this amount of deposit.  
 
After that the buyer still looking for another property, and recently put another offer for a less amount price and firmed.
 
The buyer was told by lawyer to talk to brokerage before go to court.
 
What we should to do?
